Overview

These Terms of Service (“Terms”) govern your access to and use of the Aeronux website, online store, products, services, accounts, orders, payments, and related transactions.

The terms “Aeronux,” “we,” “us,” and “our” refer to Aeronux. The terms “customer,” “you,” and “your” refer to any person or entity accessing our website or purchasing products from us.

By accessing our website, creating an account, placing an order, submitting payment, or receiving products from Aeronux, you agree to these Terms and all policies incorporated by reference.

These Terms apply unless Aeronux and the customer enter into a separate written agreement signed by an authorized Aeronux representative.

Section 1 – Eligibility and Authority

You represent that you are at least the age of majority in your jurisdiction or have permission from a parent or legal guardian to use this website and place an order.

If you purchase on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

You are responsible for protecting your account credentials and for all activity conducted through your account.

Section 2 – Website Information

We make reasonable efforts to ensure that the information displayed on our website is accurate. However, website content may occasionally contain errors, omissions, outdated information, or typographical mistakes.

We may correct, update, or remove website content at any time without prior notice.

Product descriptions, measurements, photographs, videos, colors, prices, availability, and estimated delivery times are provided for general informational purposes.

Section 3 – Product Colors and Digital Displays

Product colors displayed on a computer, phone, tablet, or other electronic device may differ from the actual product because of screen settings, lighting, photography, software, and device type.

Digital images and online color representations are not guaranteed to be exact.

Minor variations in color, texture, pattern placement, measurements, stitching, and finishing may occur and do not necessarily constitute a defect.

Section 4 – Product Information, Sizing, and Fit

Product measurements, Size Guides, fit descriptions, fabric-content information, and suggested uses are provided to help customers select the appropriate item.

Available sizes and fits may vary by product. Customers are responsible for reviewing the Size Guide and product information before placing an order.

Sizing and fit preferences vary between individuals. Aeronux does not guarantee that a particular size or style will fit every customer in the same manner.

Section 5 – Product Care

Care instructions are available on product pages and garment labels.

Customers are responsible for following the provided washing, drying, ironing, steaming, and care instructions. Aeronux is not responsible for damage caused by improper care, misuse, alterations, excessive heat, unsuitable cleaning products, or failure to follow the care instructions.

Damage resulting from normal wear and tear or improper care is not considered a manufacturing defect.

Section 6 – Orders and Acceptance

Submitting an order constitutes an offer to purchase products under these Terms.

An automated acknowledgment, website confirmation, or payment authorization does not necessarily constitute final acceptance of an order.

An order is accepted when Aeronux confirms that the order has been approved for fulfillment or ships the products, whichever occurs first.

Aeronux may accept, reject, limit, place on hold, or cancel an order for reasons including:

  • Product unavailability
  • Pricing or product-information errors
  • Suspected fraud
  • Payment problems
  • Failed security verification
  • Shipping restrictions
  • Incorrect customer information
  • Legal or regulatory concerns
  • Suspected unauthorized resale

If Aeronux cancels an order after collecting payment, we will refund the amount paid for the canceled products.

Section 7 – Personal and Resale Use

Products purchased through our website are intended primarily for personal use.

Aeronux may limit or cancel orders that appear to be placed for unauthorized resale, distribution, or other commercial purposes.

Purchasing an Aeronux product does not authorize the customer to use Aeronux trademarks, photographs, product descriptions, or other intellectual property for advertising or commercial purposes.

Section 8 – Prices

Prices are subject to change without notice.

Unless stated otherwise, displayed prices do not include:

  • Sales or use taxes
  • Shipping charges
  • Customs duties
  • Brokerage fees
  • Tariffs
  • Import charges
  • Other charges imposed by a carrier or government authority

The price charged for an order will be the price displayed and confirmed during checkout, subject to correction of clear technical or pricing errors.

Promotional pricing applies only during the stated promotion period and cannot be applied to previous purchases unless otherwise stated.

Section 9 – Pricing and Product-Information Errors

Aeronux reserves the right to correct errors involving product prices, descriptions, availability, discounts, shipping charges, sizes, colors, quantities, or other order information.

If an error is discovered before shipment, Aeronux may:

  • Correct the order with the customer’s approval
  • Cancel the affected product
  • Cancel the entire order
  • Offer an alternative product

If an affected product is canceled after payment has been collected, Aeronux will refund the amount paid for that product.

Aeronux is not required to honor a price that is clearly incorrect or resulted from a technical, typographical, system, or data-entry error.

Section 10 – Payment

Payment is due when the order is submitted unless another payment arrangement is expressly stated during checkout.

The customer represents that they are authorized to use the payment method provided.

Payments are subject to authorization, validation, fraud screening, and approval by the applicable bank or payment provider.

Aeronux may:

  • Decline or cancel a transaction
  • Request additional verification
  • Place an order on hold
  • Limit order quantities
  • Refuse additional orders associated with suspected fraud or payment abuse

A temporary authorization hold may appear on the customer’s account even if an order is later canceled. The customer’s bank or payment provider determines how long it takes to release an authorization or post a refund.

Section 11 – Taxes

Customers are responsible for applicable sales, use, import, customs, and similar taxes.

Taxes collected by Aeronux will be calculated based on the information provided during checkout and applicable legal requirements.

International customers are responsible for customs duties, import taxes, brokerage fees, and other destination-country charges not collected during checkout.

Section 12 – Promotions and Discount Codes

Aeronux may offer sales, promotional discounts, or discount codes from time to time.

Unless otherwise stated:

  • Promotional codes cannot be combined
  • Discounts cannot be applied to previous purchases
  • Promotions have no cash value
  • Certain products may be excluded
  • Promotions may be limited by date, customer, product, quantity, or order value
  • Discount codes must be entered correctly during checkout
  • Promotions may be modified or ended as permitted by law

Aeronux may cancel or refuse a discount obtained through fraud, misuse, duplication, or a technical error.

Section 13 – Order Changes and Cancellations

Order changes and cancellations are not guaranteed.

Customers should contact Aeronux as soon as possible at info@aeronux.com if an order needs to be changed or canceled.

An order cannot normally be changed or canceled after it has entered processing, been packaged, or been released to the shipping carrier.

If an order can no longer be canceled, the customer may request a return after receiving it, subject to our Refund Policy.

Section 14 – Shipping and Delivery

All processing, shipping, and delivery dates are estimates unless Aeronux expressly guarantees a delivery date in writing.

Customers are responsible for all applicable shipping charges displayed during checkout unless free or discounted shipping is offered.

Aeronux is not responsible for delays caused by:

  • Shipping carriers
  • Customs or border inspections
  • Severe weather
  • Natural disasters
  • Labor disruptions
  • Government actions
  • Public holidays
  • Incorrect shipping information
  • Delayed customer responses
  • Events outside Aeronux’s reasonable control

Customers are responsible for providing a complete and accurate delivery address and for costs resulting from an incorrect address, refused delivery, missed delivery, redelivery, address correction, or storage.

Section 15 – International Orders

International orders may be subject to customs duties, taxes, brokerage fees, tariffs, inspections, documentation requirements, and other charges imposed by the destination country or shipping carrier.

Unless otherwise stated during checkout, the customer is responsible for these charges.

Aeronux is not responsible for delays caused by customs, import restrictions, border inspections, government action, carrier delays, or incomplete customer-provided information.

Orders shipped to Mexico may require the recipient’s Federal Taxpayer Registry number, known as an RFC, or other information requested by customs or the carrier.

Customers are responsible for confirming that products may be lawfully imported into their destination country.

Section 16 – Customer Pickup

Customer pickup may be available only when approved and arranged with Aeronux in advance.

The customer or authorized representative may be required to provide identification and proof of purchase.

The customer or representative is responsible for inspecting and accepting the order at pickup.

Once the order is released, the customer is responsible for loss, theft, delay, damage, or handling issues occurring after pickup, except to the extent caused by Aeronux before release.

Section 17 – Title and Risk of Loss

Unless otherwise required by applicable law, title and risk of loss pass to the customer when Aeronux properly delivers the order to the shipping carrier.

For customer pickups, title and risk of loss pass when the order is released to the customer or the customer’s authorized representative.

Customers may be required to submit claims directly to the carrier for packages lost or damaged during transit. Aeronux may assist with reasonable documentation when appropriate.

Nothing in this section limits rights that cannot legally be waived.

Section 18 – Inspection and Claims

Customers must inspect their orders promptly after delivery.

Claims involving visible damage, missing products, incorrect items, incorrect sizes or colors, or visible defects must be submitted to Aeronux in writing within 10 calendar days of delivery.

Claims should include:

  • Customer’s name
  • Order number
  • Product name or style number
  • Size and color
  • Quantity affected
  • Description of the issue
  • Clear photographs or videos
  • Photographs of the packaging and shipping label, when applicable

The customer must preserve the product, packaging, tags, shipping labels, and related evidence while the claim is being reviewed.

Submitting a claim does not authorize the customer to return or dispose of the product or initiate a chargeback.

Section 19 – Concealed Defects

A defect that could not reasonably have been identified during the initial inspection must be reported promptly after discovery.

Claims involving concealed defects must be submitted within 30 calendar days of delivery unless a longer period is required by applicable law or an express written warranty.

Customers must stop wearing, washing, altering, or using an item after discovering a suspected defect.

Continued use after discovering a suspected defect may reduce or eliminate available remedies.

Section 20 – Returns and Exchanges

Returns must be requested within 30 calendar days of delivery. No return will be accepted without prior authorization from Aeronux.

Approved returns must be:

  • Unworn
  • Unwashed
  • Unaltered
  • Free from stains, odors, damage, and signs of wear
  • Returned with all original tags attached
  • Properly packaged
  • In resalable condition
  • Accompanied by proof of purchase

Except where required by law or approved by Aeronux in writing, the following are final sale:

  • Products marked “Final Sale”
  • Clearance products
  • Gift cards
  • Customized or personalized products
  • Special-order products
  • Products that have been worn, washed, altered, damaged, or used
  • Products without their original tags
  • Products damaged through improper care, handling, or storage

Approved non-defective returns may be subject to:

  • A 20% restocking fee
  • Original shipping charges
  • Return shipping costs
  • Inspection charges
  • Repackaging charges

Refunds or store credits will be issued only after Aeronux receives and inspects the returned products.

Exchanges are not guaranteed and are subject to availability. Please review our Refund Policy for complete requirements.

Section 21 – Remedies for Valid Product Claims

If Aeronux determines that a product was defective, damaged, incorrect, or otherwise nonconforming when delivered, Aeronux may:

  1. Replace the affected product.
  2. Issue store credit.
  3. Refund the purchase price paid for the affected product.
  4. Provide another remedy agreed to in writing.

Unless required by applicable law, Aeronux is not responsible for indirect costs or losses related to a product, including alteration costs, third-party services, lost income, lost profits, or other consequential expenses.

Section 22 – Product Warranties

Unless Aeronux provides an express written warranty for a particular product, products are subject to the limitations stated in these Terms.

Product descriptions, photographs, measurements, Size Guides, recommendations, and suggested uses are provided for general informational purposes. They are not guarantees of exact color, fit, performance, suitability, or durability.

Nothing in these Terms excludes or limits any warranty, consumer right, or legal protection that cannot legally be excluded or limited.

Section 23 – Limitation of Liability

To the fullest extent permitted by law, Aeronux and its owners, officers, employees, agents, affiliates, suppliers, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

These damages may include:

  • Lost profits or income
  • Lost business
  • Loss of goodwill
  • Business interruption
  • Data loss
  • Third-party costs
  • Alteration or replacement costs

To the fullest extent permitted by law, Aeronux’s total liability arising from a product, order, shipment, transaction, or related claim will not exceed the amount paid for the specific product giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

Section 24 – Customer Indemnification

To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Aeronux and its owners, officers, employees, agents, affiliates, suppliers, contractors, and service providers from third-party claims arising from:

  • The customer’s violation of these Terms
  • Misuse of the website or products
  • Fraudulent or unlawful activity
  • Customer-submitted content
  • Violation of another party’s rights
  • Violation of applicable law

This provision does not require the customer to indemnify Aeronux for liability caused solely by Aeronux’s gross negligence, willful misconduct, or conduct that cannot legally be indemnified.

Section 25 – Events Outside Our Control

Aeronux is not responsible for delays or failures caused by events outside our reasonable control, including:

  • Natural disasters
  • Fire or flood
  • Severe weather
  • Epidemics or public-health emergencies
  • War or civil unrest
  • Government actions
  • Tariffs or embargoes
  • Customs delays
  • Carrier disruptions
  • Labor disputes
  • Supplier interruptions
  • Utility failures
  • Cyberattacks

During such an event, Aeronux may extend delivery dates, suspend performance, limit available inventory, offer alternatives, or cancel affected orders.

If Aeronux cancels an order under this section, we will refund amounts paid for products that were not supplied.

Section 26 – Intellectual Property

The Aeronux website and its content, including the Aeronux name, trademarks, product names, text, descriptions, photographs, graphics, logos, videos, designs, and layouts, are owned by or licensed to Aeronux and protected by applicable intellectual-property laws.

Customers may not copy, reproduce, republish, distribute, modify, scrape, download, commercially exploit, or otherwise use website content without prior written permission.

Purchasing a product does not transfer ownership of Aeronux’s trademarks, photographs, website content, designs, or other intellectual property.

Section 27 – Customer Reviews and Submitted Content

When a customer submits a review, photograph, video, feedback, suggestion, or other content, the customer grants Aeronux a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, modify, and use that content for lawful business and marketing purposes.

The customer represents that:

  • They own or have permission to submit the content
  • The content is truthful
  • The content does not violate another party’s rights
  • Any incentive or business relationship has been properly disclosed

Aeronux may remove content that it reasonably believes is unlawful, fraudulent, infringing, threatening, obscene, misleading, or unrelated to the product or service.

Aeronux will not condition compensation or an incentive on a customer providing a positive review.

Section 28 – Prohibited Website Uses

Customers may not use the website to:

  • Violate applicable laws
  • Commit fraud
  • Impersonate another person
  • Infringe intellectual-property rights
  • Upload malware or harmful code
  • Interfere with website security
  • Collect personal information unlawfully
  • Scrape or extract data without permission
  • Attempt unauthorized access
  • Harass employees or other users
  • Submit false payment or account information
  • Place fraudulent or unauthorized orders

Aeronux may restrict or terminate access for suspected prohibited conduct.

Section 29 – Third-Party Services and Links

The website may use or link to third-party services, including Shopify, payment processors, shipping carriers, analytics providers, social-media platforms, and marketing providers.

Third-party services are governed by their own terms and privacy practices.

Aeronux is not responsible for the independent acts, omissions, content, security, availability, or policies of third-party websites or services, except where required by law.

Purchases made from Aeronux are transactions between the customer and Aeronux, not between the customer and Shopify.

Section 30 – Privacy

Aeronux’s collection and use of personal information are governed by our Privacy Policy.

By using the website or placing an order, the customer acknowledges the Privacy Policy.

Where required, Aeronux will provide appropriate choices concerning cookies, marketing communications, and personal information.

Section 31 – Electronic Communications

The customer agrees that Aeronux may communicate electronically regarding:

  • Orders
  • Accounts
  • Payments
  • Shipping
  • Returns and claims
  • Policy updates
  • Legal notices
  • Customer-service matters

Electronic communications satisfy requirements that communications be in writing, except where applicable law requires another method.

Marketing emails and text messages are subject to separate consent and opt-out requirements.

Section 32 – Suspension and Termination

Aeronux may suspend or terminate a customer’s account, order access, or use of the website for:

  • Fraud or suspected fraud
  • Chargeback abuse
  • Harassment
  • Website misuse
  • Violation of these Terms
  • Legal or security concerns

Termination does not eliminate payment obligations or liabilities incurred before termination.

Provisions concerning payment, intellectual property, warranties, liability, indemnification, dispute resolution, and other provisions that should reasonably survive termination will remain effective.

Section 33 – Governing Law and Venue

These Terms and disputes arising from the website, products, orders, or transactions will be governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to consumer rights that cannot be waived, the parties consent to the jurisdiction and venue of the state and federal courts located in Los Angeles County, California.

Section 34 – Dispute Resolution

Before filing a formal legal claim, the customer and Aeronux agree to make a good-faith effort to resolve the matter informally.

A written notice of dispute should include:

  • Customer’s name and contact information
  • Order number
  • Description of the dispute
  • Supporting documents
  • Requested resolution

The parties will have at least 30 days after receipt of the notice to attempt an informal resolution.

If the dispute is not resolved, either party may pursue available legal remedies subject to these Terms and applicable law.

Nothing in this section prevents either party from pursuing an eligible claim in small claims court.

Section 35 – No Waiver

Aeronux’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.

A waiver is effective only when stated in writing by an authorized Aeronux representative.

Section 36 – Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the greatest extent permitted by law.

The remaining provisions will continue in effect.

Section 37 – Assignment

Customers may not assign or transfer their rights or obligations under these Terms without Aeronux’s prior written consent.

Aeronux may assign these Terms in connection with a merger, sale, reorganization, change in ownership, transfer of assets, or transfer to an affiliate.

Section 38 – Entire Agreement

These Terms, together with the applicable order confirmation, Refund Policy, Privacy Policy, and Shipping Policy, constitute the agreement between Aeronux and the customer concerning the transaction.

They supersede previous communications concerning the same subject, except for a separate written agreement signed by an authorized Aeronux representative.

Section 39 – Changes to These Terms

Aeronux may update these Terms by posting a revised version on our website.

Revised Terms apply to website use and transactions occurring on or after the stated effective date. Material changes will be communicated when required by law.

The version in effect when Aeronux accepts an order will ordinarily govern that transaction.
